Lora Bentley spoke with former White House Deputy Chief of Staff Joseph Hagin, who says that the President of the United States has absolute discretion to communicate – with some exceptions. As such, Hagin said that Obama should not be a problem of arrears, but you expect to carry out the discussion of the other to recognize the mobile device, the vulnerability is still used.
Bentley: We've all seen the coverage of Obama's BlackBerry and restrictionsuse. I was curious, what are the laws and regulations that govern how a president can communicate and use the devices can be done?
Hagin: There are very few laws and regulations, actually. With some exceptions, which has absolute discretion as it is communicated.
Bentley: What are these exceptions?
Hagin: An area that is not really much to the discretion of the laws relating to security of classified information. And classifiedsInformation, I mean technically classified information – documents or objects covered by the system of government as confidential, secret, secret, top rated, or what they call sensitive compartmentalized information, SCI. This information can not be discussed in an open line, either on radio or telephone. This information can only be discussed or passed through devices that are approved for the transmission of classified information.
That is clear. Any person whosecurity clearance has understood these rules. I would never consider the transfer of a thing a smartphone or cell phone or something. This is a very hard and fast rule.
Bentley: And the second?
Hagin: The other is the Presidential Records Act. The law states that all official communications should be by the President or his staff shall be kept on file for the making. This information is for 12 years after the last day of canningAdministration.
Bentley: But none of them is what people now affected?
Hagin: What all of these requests were for BlackBerry Obama actually means that confidential information is not classified. All told, the President of the United States or transmitting sensitive, because the transmission is the same.
Bentley: How many different organisms have an interest in these things?
Hagin: The Secret Service is concerned thatthat are not only responsible for protecting call him physically, but also the protection of the electronic invasion it's us. So we have a problem. Then the White House lawyers and the Department of Justice for a concern because of the Records Act and ensure this is to have everything covered. But they also have a concern, which is actually more of a political concern.
Bentley: And what is that?
Hagin: The ease with which people of piracy in these devices and the interception of information and systems canSpyware on them and all kinds of things. If someone take over your messages, though not classified …
Imagine that a friend of him or one of his relatives sent him something that was controversial, and that somehow got into the public domain. You can imagine, as the game of "Gotcha", which is played in Washington, the question is: Does the President to resign his friend? If the president of the CUT contact with your friend? If the President agrees with hisFriend? Suddenly, you have the president with the information they had no control over the defense of the reception. It just appeared on your BlackBerry, one day, which was leaked somehow intercepted, and suddenly record a permanent president.
Bentley: It appears that President Obama to keep his BlackBerry, so what's the point of this debate?
Hagin: One of the things I hope happens is that businesses and industry in this area … and realizedhow vulnerable they are. Because if you have ownership of sensitive information – look at the banking sector. The decisions we are making the decisions of millions of dollars. I bet you there are people who try as hard as they can to give me the information …
Unlike the late 90's, to proclaim that the people who had cut half a million computers that people today want to do it secretly. You have no fingerprints, no footprints, because they want to beCan transmit information on an ongoing basis, access to financial benefits. This is really the crux of the matter.
